These terms and conditions of use constitute a legal agreement between you and Tourism Victoria (this agreement). Please read this agreement in its entirety before you continue to use this website, order products or download any image.
This agreement will not affect any other licence or agreement you already have with Tourism Victoria, its employees, agents or sub contractors.By checking the agreement box when ordering, this indicates that you agree to be bound by the following terms and conditions and by using this website, and that you agree to be bound by the terms and conditions of this agreement.
If you do not agree, do not check the box indicating agreement, and discontinue using this website.
Agreement to these terms and conditions will result in the granting of a one off non-exclusive right to use the selected imagery for the permitted purpose as approved by Tourism Victoria (Visions of Victoria).
Ownership of Site and Content
This site is owned and operated by Tourism Victoria. All content on this site including photographs, images, illustrations, text, audio clips, video clips and software (referred to as content) is owned by Tourism Victoria or licensed to Tourism Victoria for use on this website by our content providers.
Except as expressly permitted under this agreement, under the Copyright Act 1968 (Cth) (or other applicable intellectual property legislation) or with the specified written permission of Tourism Victoria, no part of this website’s content may be reproduced by any process, electronic or otherwise, or stored in any form. For the protection of Tourism Victoria and our content providers, images on this site may be digitally watermarked.
You must retain and adhere to any copyright restrictions or other notices that appear on images you wish to download or print.
Following is an explanation of copyright restrictions that apply to Tourism Victoria's images:
Copyright Restrictions for Photography
Unlimited Use
These images can be used for any purposes, world-wide by any company or individual in accordance with this agreement.
Tourism Purposes Only
These images can only be used to promote Melbourne and Victoria through tourism related projects funded by the Tourism Industry strictly in accordance with this agreement.
Tourism Victoria Use Only
These images can only be used for the collateral produced and funded solely by Tourism Victoria in accordance with this agreement.
Mandatory Credit Required
These images must have the stated credit as per image details. Usage of images requiring mandatory crediting of the photographer or location must be credited in accordance with such credits as they appear on the image and in accordance with this agreement.
Non Commercial Purposes Only
These images cannot be used to make revenue/profit or on items created for commercial sale eg books, calendars, and must be used in accordance with this agreement.
Must Apply For Use
These images must have prior approval from the owner of the image before the client can use the image. No use of this material is permitted until Tourism Victoria has entered into a written agreement which provides the terms and conditions for use of these images.
Archive
These are images that are no longer used by Tourism Victoria due to permissions for the use talent being out of date and may not be used for any purposes.
Copyright Restrictions for Video
Unlimited Use
Footage or Videos can be used for any purposes, worldwide by any company or individual in accordance with this agreement.
Tourism Purposes Only
Footage or Videos can only be used to promote Melbourne and Victoria through tourism related projects funded by the Tourism Industry in accordance with this agreement.
Presentation Only
Footage or Videos which can only be used for presentations or viewing on big screens, may not be edited or incorporated into other products. These videos will only be made available in VHS or DVD Format. These Videos can not be used for broadcast or website use, and use for presentations or viewing on big screens must be in accordance with this agreement.
Restricted
Footage or Videos that have a copyright restriction placed on it by an external parties or Tourism Victoria. The Manager of Visions of Victoria must approve use of these Videos. No use of this material is permitted until Tourism Victoria has entered into a written agreement which provides the terms and conditions for use of restricted material.
Archive
These are Videos and Footage that are no longer used by Tourism Victoria; this video can include historical footage, old commercials and films. No one has access to this material except for Tourism Victoria.
Logo & Trademarks
Tourism Victoria and the Tourism Victoria logos are registered trademarks of Tourism Victoria. You may not use our trademarks without written permission.

All other trademarks appearing on the Tourism Victoria website are the property of their respective owners
Fees
Tourism Victoria will charge nominal fees to clients to recover operating costs.
Clients who Register maybe eligible for discounted or free access to the images available.
Tourism Victoria, through the Manager of Visual Services retains the right to waiver any fees.
All figures/prices quoted prior to confirmation of Order are in Australian dollars (unless otherwise stated) and does not include Goods and Services Tax (GST), delivery, handling or insurance.
Goods and Services Tax (GST), delivery, handling and insurance will be calcliated at the confirmation of the order and shall be itemised in accordance with GST Law.
Conditions of Use
- All material supplied is owned by Tourism Victoria or its respective partners and can not be on sold to Third Parties.
- Tourism Victoria provides the images on the basis of a one off, non-exclusive right to use the specified images for the approved use.
- All laboratory, carriage, taxes and customs on images are the purchaser's responsibility.
- All copyright requirements must be adhered to. Any misuse of images will reslit in breech of copyright and legal action will be taken.
- All material must be returned to Tourism Victoria or its suppliers or destroyed after use.
- All Mandatory CREDITS must be adhered to, without exception.
- Images must be titled correctly.
- Images supplied can only be used for the specific Region nominated by Visions of Victoria.
- Material supplied must be used only to promote Melbourne or Victoria.
- Where possible the photographer sholid be credited. (Optional unless Mandatory Credit is required)
- Where possible Tourism Victoria sholid be acknowledged. (Optional - We prefer the photographer to be credited first)
